  • 1974

    In 1974 James and Elvenia Bratton, my parents, bought our family home at 925 W. Locust St, Ontario California, 91762.

  • 1987

    My Mother grant deeded my sister and myself onto the property after my father died.

  • 1993

    My sister married in 1993 and she came off of the home. My mom came off of the home in 2005, making me the SOLE OWNER.

  • 2005/02

    In February of 2005 I was SOLICITED to refinance my home by a Rose from Fast Tract Financial.

    At the time my mortgage was $1,100 and my interest rate was 8%. Rose told me that I had equity in my home of 200,000 dollars I could use.

    I drove into Newport Beach Ca to sign the papers. I was told that there were some new things in line, THEY WOULD SEND THE PAYMENT DISCLOSURES AT A LATER DATE.

    I was then told that they were still vetting lenders. I asked them why I was signing blank pages? At the time I was signing I had not received any disclosures.

    I ended up closing in March of 2005. I was adamantly told that I qualified for a fixed rate of 6-7% because of my good credit and payment history.

    We then reevaluated what I was told, my expectations, and they reassured my I was going to get a fixed interest rate of 6-7% and the payment would be easy.

    I finally received payment disclosures when they sent me the first statement payment of 70,000$. My new rate was now 9% adjustable to hop to 12 in 3 months.

    I immediately called the broker and complained about not receiving the full $200,000 I was promised. I also complained about my high interest rate.

    The broker told me that they needed to work my credit up by making 3-6 months of payments and acknowledged not paying me the full amount.

    I requested a rescinding of the loan but was told the deadline passed. I did exactly as I was told. I made July and August's payments of almost 3,000 dollars.

    Fast Tract Financial called me and told me that the new appraiser would be contacting me to come out and do a new appraisal. This was going to be another REFI.

    I was told again and expected a 6-7% interest rate and the 80,000$ I was owed. I ended up with an 80/20. First Refi at 8% with a second at 10%. My rate was 18%.

    The docs were signed on this 6/30. On 7/29 I received mail stating that the disclosures would come later. This later was in 2009.

    From 2005-2007 I made all of the elevated payments. In June 2007 First Franklin's customer service told me that I could get a modification.

    First Franklin told me that I first needed to be on a payment plan. I was told that someone would be calling me from the pre paid DEPT to discuss payments.

    I was also told that I INTENTIONALLY NEEDED TO MISS TWO PAYMENTS. I was told in order to qualify for a modification, I needed to show that I was struggling.

    I skipped July and August's payments. I then called in about September's payment. I was told to hold off on payment.

    In October I received a call from the pre paid department. They went over a plan for me to get caught up on my mortgage.

    The first payment was going to be $5,681. I was told it was this high to cover Oct payment and July's in full. I started making the payments.

    I was told that my payments would start on the 30th of each month. This Oct payment would cover Oct even though I used to make my payments on the 1st.

    On this date I received a Notice of Default posted on my door. I was instructed that once I made the first two payments in Oct and Nov I could call.

    I was told that all of my paperwork would be forwarded to the REMODIFICATION department and that I could call in Dec. I got no call and kept making payments.

    The last payment was due on April 30th, 2008. In April I received notice about a TRUSTEE DEED UPON sale on 4-11-08. I HAD NO IDEA WHO WAS FORECLOSING ON ME.

    In May I received a 3 day notice to quit. Next I received the summons & complaint. I had pre paid legal so I called them to see if they would take my case.

    I was told that I would receive another three day notice. They then told me if I was stating a wrongful foreclosure I would not want to go through with it.

    I was told that when I get the 3 day notice to just put it away. After that they would be forced to do a summons & complaint in unlawful detainer court.

    In U.D court I was trying to be forced out of my home. This ended up being vacated because the lender called in and said they were dismissing the case.

    In Sept of 08 I received a welcome Letter from Select Portfolio Services stating they were my new servicer and gave me a new loan number and payment schedule.

    I found a man from SPS taking pictures of my home. He stated that the property should have been vacated and that he was from South Hills Properties.

    The man called SHP right there. A woman named Ally answered. She stated that she owns the home, just made the payment, and getting ready to make Nov payment.

    Ally then told me that the payment I just sent was being returned in full. I called SPS and they confirmed that they were sending my payment back.

    In November of 2008 I contacted an attorney and tried to arrange to have a family member purchase my home. I was directed by Select Portfolio to contact SHP.

    Between Nov 2008 and Feb 5th 2009 when I received my next eviction notice, I never received any information from SPS or my attorney that my offer was accepted.

    I then had my attorney file a lawsuit for fraud. The defendant's were First Franklin, U.S. Bank, and SPS. A U.D hearing took place on 2/5/2009.

    At this hearing a Writ of Possession was granted to SPS. I was told that I would have to leave my home. The eviction date the judge gave me was 3/16/2009.

    While I was waiting to hear about the offer my family member made I was receiving a lot of mail stating WELCOME TO THE NEIGHBORHOOD and other advertisements.

    These advertisements were targeted at a Rosela Guevara. I went to Chicago Title and they pulled the property file and confirmed this unknown woman on MY TITLE!.

    On this day I went into South Hills Properties to speak to them. I was told this was a MISTAKE and that they were going TO LET US BACK IN OUR HOME!

    On this date I was given the keys to re enter my home by a Lonny from SHP. From 4/8/2009 on, no one from SPS gave ME INSTRUCTIONS ON WHERE TO MAKE MY PAYMENTS.

    On this day I had a Notice of Decision served on me. The Trustee that conducted the Trustee sale on 4/11/2008.

  • 2010/01

    I was contacted by attorney Gina Albertson. She asked me if I received a second notice of foreclosure. I replied no. She stated if I did, disregard.

    I received a call from SPS trying to cut the debt but they did not tell me where to send payment.

    I filed a complaint against Select Portfolio Servicing with the Federal Trade Commission

  • 2011/10/18

    U.S. Bank sent me a NOTICE OF DEFAULT. QUALITY LOAN SERVICING was handling the foreclosure for U.S. Bank.

    I filed a lawsuit for WRONGFUL FORECLOSURE and filed a LIS PENDENS with the San Bernardino County Recorder's office to let people know the title had a issue.

    Received notice of TRUSTEE SALE.

    I was foreclosed upon for a second time.

    The outcome of the unlawful detainer hearing on this day was that U.S. Bank was issued a WRIT OF POSSESSION on my home.

    At this exact point in time I was appealing my wrongful conviction and I had a fraud lawsuit pending. I was hopeful that I would get a positive resolution.

    I called the Ontario Police Department and requested they come out to take my fraud report. I spoke to a detective Hurst's assistant and showed her my paperwork

    Attempted to speak to officer Hurst and explain the information his assistant gave him about my fraud report. He was very rude and acted like I had no problem.

    Retired Chief Eric Hopley told me at a meeting with Paul Bednik from OPD Internal Affairs that I would need to file a I.A complaint against Hurst.

    County Recorders office I filed a CORRECTED & WARRANTY DEED. I received valid information of fraud on the docs used to sell my home by Ca attorney general.
